1. Introduction
1.1 This Platform Role and Legal Services Disclaimer (“Disclaimer”) explains the role of ClariCase, the services we provide, the services we do not provide, and the relationship between ClariCase, Independent Lawyers and Users of the Platform.
1.2 This Disclaimer forms part of the ClariCase Terms of Service. Capitalised terms not defined here have the meanings assigned to them in the Terms of Service.
1.3 By accessing or using the Platform or any ClariCase Services, you acknowledge that you have read, understood and agree to this Disclaimer.
2. ClariCase Is Not a Law Firm
2.1 ClariCase is a technology-enabled legal concierge and case coordination platform. We are not a law firm, an advocate’s office, a legal practice or a provider of professional legal representation.
2.2 ClariCase does not itself provide legal advice, legal opinions, litigation strategy, court representation, legal drafting, pleadings, legal filings, advocacy or any other professional legal service that may lawfully be provided only by a qualified legal practitioner.
2.3 Our role is to provide technology, administrative support, document organisation, coordination, communication tools, case management features, reminders, operational assistance and related concierge services that help Users manage their legal matters more efficiently.
2.4 Nothing on the Platform should be interpreted as representing ClariCase as your lawyer, legal representative or legal adviser.
2.5 Nothing on the Platform is intended to be, or should be construed as, advertisement, solicitation or inducement of legal work by or on behalf of any Independent Lawyer. ClariCase does not act as a tout and does not procure legal business for consideration.
3. Role of Independent Lawyers
3.1 Professional legal services made available through or in connection with the Platform are provided exclusively by Independent Lawyers.
3.2 Each Independent Lawyer remains solely responsible for their professional judgment, legal advice, representation, drafting, strategy, court appearances, ethical obligations, fee arrangements and communications with the User.
3.3 Independent Lawyers are independent professionals. Their availability through the Platform does not create an employment, partnership, agency, joint venture or similar relationship with ClariCase.
3.4 ClariCase neither directs nor controls the professional judgment exercised by an Independent Lawyer and does not assume responsibility for the legal services provided by them.
4. Relationship Between Users and Independent Lawyers
4.1 A lawyer-client relationship is created only when an Independent Lawyer accepts the matter and the User and the lawyer enter into a separate Lawyer Engagement.
4.2 The Independent Lawyer is responsible for conflict checks and may decline an engagement.
4.3 ClariCase is not a party to the professional relationship and does not assume the lawyer’s duties, privileges or professional obligations. Any questions relating to legal advice, representation, fees, litigation strategy, conflicts of interest, confidentiality owed by the lawyer, or professional obligations should be addressed directly with the engaged Independent Lawyer.
4.4 Legal fees, retainers, billing, withdrawal, file retention and refunds of unearned professional fees are governed by the Lawyer Engagement and applicable professional rules.
5. Information on the Platform Is Not Legal Advice
5.1 The Platform may contain educational content, articles, guides, FAQs, templates, checklists, reminders, legal updates and other informational resources.
5.2 Such material is intended solely to assist Users in understanding legal processes, organising information and managing legal matters more effectively. It is general in nature and should not be treated as legal advice or as a substitute for advice based on the specific facts, applicable law and circumstances of a particular matter.
5.3 Users should obtain professional legal advice from an Independent Lawyer before making decisions that may affect their legal rights or obligations.
6. Lawyer Matching and Profiles
6.1 Where offered, ClariCase may facilitate introductions based on practice area, jurisdiction, language, availability, location, operational requirements and information supplied by the User.
6.2 An introduction is not a certification, recommendation, endorsement or guarantee of competence, suitability, availability or outcome. ClariCase does not rank, grade or rate Independent Lawyers and does not describe any lawyer as the “best”, “top” or “most successful”.
6.3 ClariCase does not accept payment from an Independent Lawyer for preferential ranking, listing or matching, and does not receive any commission calculated by reference to professional fees, engagement or outcome.
6.4 Any credential verification is limited to the records or representations actually checked and does not replace the User’s own assessment. The User may request relevant professional details before engagement.
6.5 Only the minimum information reasonably necessary will be shared for a conflict or availability check. Detailed documents will be shared only after appropriate authorisation.
6.6 Complaints concerning an Independent Lawyer’s professional conduct should ordinarily be raised with the lawyer and may also be submitted to the relevant State Bar Council or other competent professional authority.
7. Documents, Dashboard and Administrative Support
7.1 The Platform may assist Users in collecting, organising, categorising, storing or sharing documents for administrative convenience. ClariCase does not determine their legal accuracy, completeness, admissibility, evidentiary value or legal effect.
7.2 Dashboard updates, reminders, hearing entries, workflow indicators and status information are administrative tools. Users must verify legal deadlines, filing requirements and procedural steps with the engaged Independent Lawyer or the relevant authority.
8. Confidentiality and Legal Privilege
8.1 Communications directly with an engaged Independent Lawyer may be protected by professional confidentiality or legal privilege. Communications with ClariCase, Case Managers or support personnel are protected by contractual confidentiality and privacy safeguards but are not automatically privileged.
8.2 Users should avoid submitting unnecessary privileged or highly sensitive material before a lawyer has accepted the engagement and disclosure has been authorised.
9. Artificial Intelligence and Automated Tools
9.1 Any automated or artificial intelligence functionality is intended to support administrative workflows and may produce incomplete or inaccurate outputs.
9.2 Such functionality does not provide legal advice and must not replace review by the User and, where legal judgment is required, by an Independent Lawyer.
10. Professional Independence
10.1 Independent Lawyers exercise their professional judgment independently and in accordance with Applicable Law and professional obligations.
10.2 ClariCase does not influence legal advice, litigation strategy, negotiations, settlement decisions, professional opinions or other matters requiring independent legal judgment.
10.3 Nothing in the operation of the Platform should be interpreted as permitting ClariCase to direct or interfere with the professional responsibilities of an Independent Lawyer.
11. No Guarantee of Legal Outcomes
11.1 Legal matters are inherently uncertain and depend upon numerous factors beyond ClariCase’s control, including applicable law, evidence, judicial discretion, procedural requirements, the conduct of opposing parties and the independent judgment of the engaged lawyer.
11.2 ClariCase makes no representation or guarantee regarding the outcome, duration, success or resolution of any legal matter.
12. Third-Party Services
12.1 The Platform may rely on payment processors, cloud providers, communications tools, identity verification services, document systems, analytics, cybersecurity vendors and approved artificial intelligence providers.
12.2 Where a provider processes information on ClariCase’s behalf, ClariCase will use reasonable contractual and security safeguards. Services independently selected by a User or an Independent Lawyer are governed by their own terms.
12.3 The inclusion of a third party or an Independent Lawyer on the Platform does not constitute an endorsement unless ClariCase expressly states the limited nature of that endorsement.
13. User Responsibility
13.1 Users remain responsible for the decisions they make in relation to their legal matters, including the decision to engage an Independent Lawyer, the instructions provided to that lawyer, the accuracy and completeness of information submitted through the Platform, and compliance with applicable legal obligations.
13.2 Users should review all legal advice received from an Independent Lawyer and seek clarification whenever necessary before acting upon it.
14. Limitation of Responsibility
14.1 ClariCase’s responsibility is limited to providing the Platform and the Services described in the Terms of Service.
14.2 ClariCase is not responsible for legal advice, professional services, judicial decisions, regulatory action, legal outcomes, or the acts or omissions of Independent Lawyers or other third parties.
14.3 The limitations of liability applicable to ClariCase are governed by Clause 12 of the Terms of Service and are subject to Applicable Law.
15. Changes to this Disclaimer
15.1 ClariCase may update this Disclaimer to reflect changes in the Platform, the Services, Applicable Law or business practices.
15.2 Material changes will take effect in accordance with the Terms of Service.
