1. Introduction
1.1 At ClariCase, we aim to provide a transparent user experience. This Refund Policy explains when refunds may be available for payments made to ClariCase, how refund requests are assessed, and the circumstances in which refunds may not be granted.
1.2 This Refund Policy forms part of the ClariCase Terms of Service. Capitalised terms used in this Policy have the meanings assigned to them in the Terms of Service.
1.3 By purchasing a Subscription Plan, an add-on service or any other paid service offered by ClariCase, you acknowledge that you have read and agree to this Refund Policy.
2. Scope
2.1 This Refund Policy applies to payments made directly to ClariCase for Subscription Plans, Platform services, concierge assistance, coordination services, administrative fees, add-on services and any other fees expressly charged by ClariCase.
2.2 Unless expressly stated otherwise in writing, this Policy does not apply to amounts payable to an Independent Lawyer or to any third party, including court fees, government charges, filing fees, registration fees, stamp duty, notarisation costs, travel expenses, courier charges, expert fees, translation costs or similar external costs.
3. General Refund Principles
3.1 ClariCase provides technology-enabled legal support services that involve operational preparation, platform configuration, administrative work, document organisation, lawyer coordination, customer support and ongoing account management.
3.2 Because many of these activities begin after a purchase is made, refund eligibility may reduce or cease once a material and identifiable service milestone has commenced.
3.3 Refund requests are assessed individually in accordance with this Policy, Applicable Law and the specific circumstances of each request.
4. Service Activation and Material Milestones
4.1 For the purposes of this Policy, a Service may be considered activated when ClariCase has begun performing any meaningful operational, administrative, technical, or coordination activity relating to your purchase.
4.2 Examples of activation include:
confirmation of your subscription or payment;
commencement of onboarding;
activation of your account or dashboard;
assignment of a Case Manager or coordinator;
initiation of lawyer matching or consultation scheduling;
commencement of document collection, organization, or review workflows;
configuration of reminders, alerts, or account features;
initiation of customer support or coordination services; or
availability of subscription benefits or paid features.
4.3 Once a Service has been activated, refund eligibility may be reduced or unavailable depending on the work already completed, operational costs incurred, and the nature of the services provided.
5. Refund Eligibility
5.1 If User requests a refund before ClariCase has activated your purchased Service or commenced any material work relating to their account, ClariCase may consider issuing a refund, subject to verification and the terms of this Policy.
5.2 Refund requests should generally be submitted within [7] days of payment unless a different period is expressly stated for the applicable plan or required by law.
5.3 Where a refund is approved, ClariCase may deduct applicable payment gateway charges, banking fees, taxes that cannot legally be recovered, currency conversion costs, administrative expenses, and other non-recoverable costs where permitted by applicable law.
6. Circumstances That Ordinarily Do Not Create Refund Eligibility
6.1 A refund will not ordinarily be granted solely because:
(a) the User changes their mind after a material milestone begins;
(b) the User decides not to pursue the legal matter or engages another provider;
(c) the User fails to provide reasonably requested information, attend a confirmed interaction or respond within a reasonable period;
(d) the User is dissatisfied with legal advice, strategy or professional conduct attributable to an Independent Lawyer;
(e) a court, regulator, government office, opposing party or third party causes delay or an unfavourable result; or
(f) access is suspended or terminated for the User’s material breach of the Terms of Service.
6.2 Refund requests may be declined where, among other circumstances:
the purchased Service has already been activated;
onboarding or account setup has commenced;
a Case Manager or coordinator has been assigned;
lawyer matching or consultation coordination has begun;
documents have been uploaded, organized, or reviewed;
reminders, alerts, or platform features have been configured;
customer support or coordination services have already been provided;
any subscription benefit or add-on has been accessed or used;
the purchased service has been substantially or fully performed.
7. Lawyer Fees and Third-Party Charges
7.1 Payments made to ClariCase are separate from fees charged by an Independent Lawyer.
7.2 Where a User engages an Independent Lawyer, any refund relating to that lawyer’s professional fees is governed by the Lawyer Engagement and applicable professional rules.
7.3 ClariCase is not responsible for refunding payments made directly to an Independent Lawyer or to any other third party.
7.4 Court fees, government charges, filing fees, registry fees, stamp duty, notarisation expenses, travel costs, courier fees, expert fees, translation costs and other third-party expenses are non-refundable only to the extent actually paid or irreversibly incurred.
8. Add-On Services
8.1 Certain optional services may be purchased separately from a Subscription Plan, including legal health audits, document review coordination, priority support, digital storage services, compliance reminders, template libraries, legal query support or similar offerings. Any such service that requires legal judgment is delivered exclusively by an Independent Lawyer under a separate Lawyer Engagement.
8.2 Refunds for add-on services will not ordinarily be available once access has been provided, work has commenced, support has been delivered, templates have been made available, or the purchased service has otherwise been substantially performed.
8.3 If ClariCase is unable to deliver an add-on service, ClariCase may provide an alternative service, reschedule the service, issue service credit, or approve a full or partial refund, at the User’s reasonable election where Applicable Law so requires.
9. Renewals, Upgrades and Downgrades
9.1 Autopay is enabled only through an affirmative opt-in. ClariCase will disclose the renewal term, price and billing cycle, and will provide a reasonable reminder before an annual renewal and before any renewal involving a material price change.
9.2 A renewal refund may be approved where the User requests cancellation within seven (7) calendar days after the renewal charge and no material benefit of the renewed term has been used. Applicable Law may require a different result.
9.3 Upgrade charges are non-refundable only to the extent upgraded benefits have been used or material work has commenced.
9.4 A downgrade ordinarily takes effect from the next renewal period unless otherwise agreed.
10. Payment Disputes and Chargebacks
10.1 If you believe you have been incorrectly charged or have concerns regarding a payment, we encourage you to contact ClariCase before initiating a chargeback or payment dispute through your bank or payment provider.
10.2 Where a chargeback is initiated without first attempting to resolve the issue directly, ClariCase may temporarily suspend access to affected Services while the dispute is investigated.
10.3 ClariCase may provide invoices, payment records, onboarding records, communication logs, service activation records and other relevant evidence to payment processors, financial institutions or competent authorities in connection with any payment dispute.
11. Requesting a Refund
11.1 Refund requests may be submitted to connect@claricase.com or through the designated support or grievance channel, and should include, where available:
(a) full name and registered contact details;
(b) payment receipt, invoice, transaction reference or payment ID;
(c) the purchased plan or Service and the payment date;
(d) the reason for the request; and
(e) supporting information reasonably necessary to assess the request.
11.2 ClariCase may request additional information to verify your identity, payment, or eligibility before processing any refund request.
11.3 Failure to provide reasonably requested information may delay or prevent the assessment of your request.
12. Assessment and Processing Timelines
12.1 Where a refund is approved, ClariCase will generally process the refund using the original payment method unless another method is agreed or required by law.
12.2 Approved refunds are typically processed within [30] business days, although the actual time required for the funds to appear may depend on banks, payment gateways, card issuers, or other financial institutions.
12.3 Approved refunds will ordinarily be initiated to the original payment method unless requested otherwise, subject to discretion of ClariCase.
13. Legal Outcomes
13.1 ClariCase does not guarantee any legal outcome, court decision, settlement, administrative approval, government action, or the professional advice provided by an Independent Lawyer.
13.2 Refunds will not be granted solely because a User is dissatisfied with the outcome of a legal matter, the duration of proceedings, judicial decisions, regulatory action, opposing party conduct or legal advice received.
14. Discretionary Remedies
14.1 Nothing in this Policy prevents ClariCase from voluntarily offering, at its discretion and without admitting liability, a partial refund, service credit, replacement service, extension of benefits, rescheduled service or other goodwill resolution.
14.2 A discretionary remedy provided in one instance does not create a continuing obligation or establish a precedent for future refund requests.
15. Changes to this Refund Policy
15.1 ClariCase may update or modify this Policy to reflect legal, operational or Service changes.
15.2 Unless Applicable Law requires otherwise, the version in effect at the time of purchase or renewal will govern that transaction.
15.3 User’s continued use of the Services following any update constitutes acceptance of the revised Policy.
